a. When visiting www.4mybaby.ch
When you visit our website, our servers temporarily save each access in a log file. The following data is collected without your intervention and stored by us until automatic deletion after twelve months at the latest:
- the IP address of the requesting computer,
- the date and time of access,
- the name and URL of the file accessed,
- the website from which the access was made,
- the operating system of your computer and the browser you used,
- the country from which you accessed the site
- the name of your internet access provider.
This data is collected and processed for the purpose of enabling the use of our website (connection establishment), to ensure system security and stability on a permanent basis and to enable the optimisation of our Internet offering, as well as for internal statistical purposes. The IP address is only evaluated in the event of attacks on the network infrastructure of www.4mybaby.ch and for statistical purposes.
b. When registering for a customer account
The entry of personal data for the creation of your customer account on our website is voluntary. The truthful entry of certain personal data is mandatory. This concerns
- First name
- Surname
- Address
- Date of birth
- E-mail address
- Password
We require this data for the processing and administration of our website, to check the plausibility of the data entered, i.e. to establish, define the content of, process and amend the contractual relationships concluded with you via your user account. The e-mail address and the password together form the login data. The data in the customer account can be viewed and changed by the customer at any time. Finally, a customer may request the complete deletion of the customer account.
c. When using the website as a registered customer
During the use of the website by logged-in registered customers, we collect data for statistical reasons and to enable the smooth functioning of the portal. In particular, the following data is collected:
- the type, frequency and intensity of use of the website
- the duration of your membership
- the orders placed
- the composition of the shopping basket
d. in the case of a purchase
If you wish to purchase a product on our site, we require various data in order to process the purchase contract. You must provide the following data:
- Name and first name
- Postal address (street, building name, flat number, postcode, town)
- Telephone number
- E-mail address
- Payment details
- Login data (for registered customers)
The provision of additional data is voluntary.
If you are registered and have a customer account, we will save your data in the customer account for your next purchase.
2. use of your data for advertising purposes
a. Newsletter / email advertising / online advertising
You will only receive a newsletter from us at your express request. When you register for the newsletter, your email address will be used together with your consent for our own advertising purposes until you unsubscribe from the newsletter. With the newsletter you will receive weekly information about offers as well as personal product recommendations. You can unsubscribe at any time here by sending us an email to info@4mybaby.ch or via the link contained in the newsletter. We are entitled to commission third parties with the technical processing of advertising measures and are entitled to pass on your data for this purpose (cf. point 3 below).
3. passing on data to third parties
We only pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship. Furthermore, we pass on your data to third parties if this is necessary for the processing of the contract. For this purpose, we pass on the necessary data to subsidiaries, transport companies, banks and other service providers. These service providers use your data exclusively for order processing and not for any other purposes.
4. carrying out creditworthiness checks
If we make advance payments, e.g. in the case of a purchase on account, we may obtain creditworthiness information from a credit agency on the basis of mathematical-statistical procedures in order to protect our legitimate interests. For this purpose, we transmit the personal data required for a credit assessment to a credit agency and use the information received about the statistical probability of a payment default for a weighed decision about the establishment, implementation or termination of the contractual relationship. The creditworthiness information may include probability values (score values) which have been calculated on the basis of scientifically recognised mathematical-statistical procedures and which include address data in their calculation. Your interests worthy of protection are taken into account in accordance with the legal provisions.
5. transmission of personal data abroad
4mybaby AG, Wilenstrasse 17, 8832 Wollerau, is also entitled to transfer your personal data to third companies abroad, in particular subsidiaries, if this is necessary for the processing of the contract. These are obligated to data protection to the same extent as the provider itself. If the level of data protection in a country does not correspond to that in Switzerland, we will ensure by contract that the protection of your personal data corresponds to that in Switzerland at all times.
6 Right to information, deletion and correction
You can request information about your personal data stored by us at any time or view and change this data by logging in to our website with your login data. A formal request for information must be made in writing and must include proof of identity.
You may also request to delete or correct your data or user profile at any time. This can be done by sending a corresponding request by e-mail to info@4mybaby.ch. We would like to point out that if your data is deleted, it will not be possible to use our services or not to the full extent.
You can revoke your consent to certain data processing at any time with effect for the future.
Please note that legal retention periods apply to certain data. This data must be stored by us until the deadline expires. We block these files in our system and use them exclusively to fulfil our legal obligations.
7 Data security
We use appropriate technical and organisational security measures to protect your personal data stored with us against manipulation, partial or complete loss and against unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.
If you register with us as a customer, access to your customer account is only possible after entering your personal password. You should always treat your payment information confidentially and close the browser window when you have finished communicating with us, especially if you are using the computer together with others.
We also take internal company data protection very seriously. Our employees and the service companies commissioned by us have been obliged by us to maintain confidentiality and to comply with the provisions of data protection law.
8. cookies
Cookies help in many ways to make your visit to our website easier, more pleasant and more meaningful. Advantage offers from Sovendus GmbH: In order to select an advantage offer that is currently of interest to you regionally, we transmit your title, year of birth, country, postcode, hash value of the e-mail address and your IP address to Sovendus GmbH, Hermann-Veit-Str. 6, 76135 Karlsruhe (Sovendus) in pseudonymised and encrypted form (Art. 6 para. 1 f DSGVO). The pseudonymised hash value of the e-mail address will also be used by Sovendus to take into account any objection to advertising (Art. 21 para.3, Art. 6 para.1 c DSGVO). The IP address is used by Sovendus exclusively for data security purposes and is usually anonymised after seven days (Art. 6 para. 1 f DSGVO).
Insofar as necessary for the respective advantage offer, your name, address data, e-mail address and/or telephone number will be transmitted by us in encrypted form to Sovendus when you click on the advantage offer in order to prepare the personalised request for the advantage offer from the product provider (Art. 6 para.1 b, f DSGVO).
